Experimental Aircraft Exhaust, Inc. Terms of Warranty and Liability Statement
Due to the nature of our core business the following statement of our terms for our product and services are listed below for clarification reasons:
- Components fabricated or repaired from this facility are to be used for experimental applications only. If the owner/installer elects to utilize these components on a certified aircraft, they do so at their own risk.
- Since Experimental Aircraft Exhaust, Inc. is not involved in the final installation or operation of the supplied component, we don't have the opportunity to verify the airworthiness of the component. Owner/installer is to verify the airworthiness of said component.
- Advice given is for reference only. Since the exact application is not at our location, we can only speculate on all of the installations details.

Waiver
I,
_______________, (“Client”), acknowledge that in contracting with Experimental
Aircraft Exhaust Inc.(“EAE”) for the construction of a system, part, component,
or product (collectively referred to as “Parts”) Client is making the
determination of the airworthiness and fitness for flight of any Parts that are
manufactured by EAE.
EAE
builds any Parts per Client’s specifications. Customer assumes all liability in
the event of failure, malfunction, nonperformance, or noncompliance of any Part.
This liability provision is to be given the broadest interpretation possible.
Client
WAIVES, RELEASES, AND DISCHARGES EAE and/or its directors, officers, employees,
volunteers, representatives, and agents (the “Releasees”), from any and all
liability, including but not limited to, liability arising from the negligence
or fault of the entities or persons released, for their death, disability,
personal injury, property damage, or actions of any kind which may hereafter
occur that may be in any way, or is alleged to be in any way, attributable to
any Part designed, manufactured, or provided by EAE, including by way of example
and not limitation, any risks that may arise from negligence or carelessness on
the part of the persons or entities being released, from dangerous or defective
equipment or property owned, maintained, or controlled by them, or because of
their possible liability without fault.
Client
further agrees to INDEMNIFY, HOLD HARMLESS, AND DEFEND AGAINST SUIT the Releasees
from any and all liabilities or claims made by others a result of participation
in this activity, whether caused by the negligence of release or otherwise, by
third-parties referring or relating in any way to any Part provided by EAE.
I acknowledge that the Company and its
directors, officers, volunteers, representatives, and agents are NOT
responsible for errors, omissions, acts, or failures to act of any party or
entity conducting a specific activity on their behalf.
I CERTIFY THAT I HAVE READ THIS
DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE
OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
